Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the MIDI Lab AI website (the "Service") operated by MIDI Lab AI ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the Service.
You must be at least 13 years old (or 16 years old in the European Union) to use this Service. If you are under 18 years old, you represent that you have your parent's or guardian's permission to use the Service and that they have agreed to these Terms on your behalf.
If you are a parent or guardian and believe your child under 13 (or 16 in the EU) has provided us with personal information, please contact us immediately at midilabai@gmail.com.
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password and for all activities that occur under your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar, or obscene.
We offer various subscription plans and one-time credit packs. Subscription fees are charged in advance on a recurring basis (monthly or annually) until you cancel. One-time credit packs are charged once at the time of purchase.
All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. We do not store your credit card information on our servers.
You may cancel your subscription at any time through your account settings or by accessing the Stripe Customer Portal. Cancellation will take effect at the end of your current billing period. You will continue to have access to subscription features until the end of your paid period.
No Refunds: Subscription fees are non-refundable. Once a subscription period has begun, you will not receive a refund for any unused portion of that period, even if you cancel mid-period.
One-time credit pack purchases are final and non-refundable. Credits do not expire and remain in your account until used.
We reserve the right to modify subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewal periods. We will notify you of any price changes at least 30 days in advance.
If a payment fails, we will attempt to process it again. If payment continues to fail, your subscription may be suspended or terminated. You are responsible for ensuring your payment method is valid and up to date.
Subscription Fees: Subscription fees are non-refundable. We do not provide refunds for partial subscription periods or unused subscription time.
Credit Packs: One-time credit pack purchases are final and non-refundable. Credits are delivered immediately upon purchase and cannot be returned.
Exceptions: In exceptional circumstances, such as technical errors on our part that prevent you from using the Service, we may, at our sole discretion, provide a refund or credit. To request a refund, please contact us at midilabai@gmail.com with details of your situation.
The Service and its original content, features and functionality are and will remain the exclusive property of MIDI Lab AI and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
The Service and its underlying systems and methods may be the subject of pending or issued U.S. patent applications.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or commercial use, subject to these Terms.
You retain all your rights to any content you submit, post or display on or through the Service (including forum posts, comments, and generated MIDI files). You are responsible for protecting those rights.
By posting content on the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content solely for the purpose of operating and providing the Service.
We take no responsibility and assume no liability for Content you or any third-party posts on or through the Service. You represent and warrant that you own or have the necessary rights to any content you post.
We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, is harmful, offensive, or inappropriate.
When you generate MIDI content using our Service, you own the rights to that content. However, you acknowledge that:
You retain all rights to your original prompts, customizations, and modifications to generated content. However, the raw AI-generated output may be similar to other AI-generated content due to the nature of machine learning models.
When you create and perform music in MIDI Lab AI, we record aspects of your in-app performance — including your controller and on-screen knob movements (MIDI Control Change gestures), note timing and velocity, synthesizer patch settings, and the generation context (such as your prompt, genre, and the generated directive), together with your outcome for each take (kept, saved, or discarded).
This performance data trains your own personal AI model (your "twin") — a private, personalized layer that learns your style and shapes what MIDI Lab AI generates for you. Your individual recordings and raw performances are never shared with other users. We also use your performance data, consistent with our Privacy Policy, to train, evaluate, and improve the Service's underlying AI models and features generally.
Separately, and entirely optionally, you may choose to contribute aggregated statistics derived from your performance data (for example, filter cutoff, envelope, or LFO behavior) to a shared crowd model that helps generations start off smarter for every user. This is not required to use the Service and is off unless you turn it on — we ask you with a separate, unticked checkbox, and you can change your answer at any time under Data Sharing in your account settings. Contributions never include your individual recordings or raw performances — only aggregate statistics combined across a minimum number of contributing users. Turning it off stops future contributions immediately, but does not retroactively remove aggregates already published.
You grant MIDI Lab AI a license to use your performance data as described above. This data is associated with your account and handled in accordance with our Privacy Policy. We do not sell this data. You may request deletion of your recorded performance data at any time by contacting us at midilabai@gmail.com. Deletion removes it from future training sets; models already trained (including your personal twin and the shared crowd model) are not retroactively altered.
Our Service includes a community forum where users can post content, ask questions, and share experiences. When using the forum, you agree to:
We reserve the right to moderate, edit, or remove any forum content that violates these guidelines or our Terms of Service. We may also suspend or terminate accounts that repeatedly violate these guidelines. Our moderation decisions are final.
By posting content on the forum, you grant us a worldwide, non-exclusive, royalty-free license to display, distribute, and modify your content solely for the purpose of operating and maintaining the forum.
MIDI Lab AI includes a direct messaging feature that allows registered users to send private text messages to one another. By using direct messaging, you agree to:
Direct messages are stored on our servers to deliver them to recipients and maintain conversation history. While messages are intended to be private between the two parties, we reserve the right to review message content where we have reasonable grounds to believe a violation of these Terms has occurred, such as reports of harassment or illegal activity.
The @official MIDI Lab account is the verified support account operated by MIDI Lab AI. You will receive a welcome message from this account when you sign up. If you have a question or need help, you can reply directly to start a support conversation. No other account should claim to represent MIDI Lab AI support — if you receive a message from an account falsely claiming to be MIDI Lab AI, please report it immediately.
We do not guarantee the privacy of direct messages in the event of a security incident, legal compulsion, or account dispute investigation. Use direct messages at your own risk.
MIDI Lab AI includes a social following system. When you follow another user, your follow relationship (follower count, following count) is visible on both users' public profiles. The following rules apply:
Notifications: You will receive in-app notifications when users you follow share new tracks or presets, go live in a Jam Session, or when we send platform announcements. We may send platform-wide broadcast notifications to all users, or to specific user segments (e.g., paid subscribers), to communicate important updates, feature launches, or announcements. These are not marketing emails — they are in-app notifications delivered through the bell icon in the platform header. You can manage related notification settings in your Notification Settings page.
The Infinite Jam feature allows users to host real-time collaborative music sessions ("Jam Sessions") where a host and admitted collaborators generate and evolve MIDI together in real time. Viewers may watch without contributing. By participating in a Jam Session, you agree to the following:
The session host has full moderation authority. The host may admit, deny, promote, demote, or remove any participant at any time, for any reason, without notice. MIDI Lab AI does not adjudicate disputes between hosts and participants over admission or removal decisions.
The same community standards that apply to the Forum and direct messaging apply to in-session chat. You may not use session chat to harass, threaten, spam, or abuse other participants. MIDI Lab AI reserves the right to remove any participant from a session and may suspend or terminate accounts for in-session misconduct.
MIDI content evolved or generated during a Jam Session may reflect contributions from multiple participants. You acknowledge that:
MIDI Lab AI does not record Jam Sessions on your behalf. If you wish to capture audio or MIDI output from a session, you are responsible for setting up your own recording solution (e.g., recording MIDI output in your DAW or using screen recording software).
You may record your own participation in a Jam Session for personal use. If you wish to record and publicly distribute audio or video that includes other participants' contributions, you must obtain their consent prior to doing so. MIDI Lab AI is not responsible for any disputes arising from the recording or distribution of session content.
Hosts may create private Jam Sessions that are not listed publicly in the Live Rooms feed. Private sessions are accessible only via the direct invite link. However, "private" refers to discoverability — we do not provide end-to-end encryption for Jam Session data. Session metadata and chat messages are stored on our servers and remain accessible to MIDI Lab AI for safety and service operations.
When a user is an admitted participant in an active Jam Session, a reference to that session may be visible on their public profile page as a "Live Now" indicator. This allows followers and visitors to join or watch. When the session ends or the user leaves, this indicator is removed automatically.
MIDI Lab AI offers optional SMS notifications to users who choose to enable them. SMS notifications are account-specific and require a verified MIDI Lab AI account. Opt-in is not available to users without an account.
To receive SMS notifications, you must: (1) be signed in to your MIDI Lab AI account, (2) navigate to your notification preferences at /notification-settings, (3) enter your mobile phone number, (4) check the unchecked consent checkbox agreeing to receive recurring automated text messages from MIDI Lab AI, and (5) verify your phone number via a one-time code. No SMS will be sent before OTP verification is complete.
SMS messages may include product activity updates (such as generation or export completion), account and credit notices, and important service notices.
Message frequency is low and driven by your account activity and the notification preferences you have enabled. Msg & Data rates may apply. Contact your mobile carrier for details.
You may opt out of SMS notifications at any time by replying STOP to any message we send. You may also disable SMS notifications from your notification preferences page at /notification-settings. After opting out, you will receive a single confirmation message and no further SMS will be sent. Reply HELP to any message for help or contact us at midilabai@gmail.com.
Consent to receive SMS messages is not a condition of purchasing any product or service from MIDI Lab AI.
The MIDI content and musical ideas generated by this Service are created by artificial intelligence. While we strive for originality, given the finite nature of musical scales and common chord progressions, we cannot guarantee that the generated output will not coincidentally resemble existing copyrighted works.
Use at Your Own Risk: You acknowledge and agree that you use all generated MIDI content entirely at your own risk. MIDI Lab AI accepts no liability for any copyright infringement claims, legal disputes, or damages arising from your use, distribution, or commercialization of the generated files.
Customization Recommended: We strongly encourage users to treat the generated MIDI as a creative starting point. To ensure uniqueness and avoid potential copyright issues, we recommend modifying, customizing, and rearranging the notes, timing, and structure within your Digital Audio Workstation (DAW) before using them in commercial projects.
No Warranty: The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We may offer beta features, experimental functionality, or early access to new features. These features are provided "as is" and may be unstable, incomplete, or subject to change without notice.
By using beta features, you acknowledge that:
We encourage users to provide feedback on beta features, but we are not obligated to implement any suggestions or address any issues reported.
We offer a referral program that allows users to earn credits by referring new users to our Service. The following terms apply to the referral program:
If we suspect fraudulent activity or abuse of the referral program, we reserve the right to suspend or terminate your account and revoke any referral credits earned through fraudulent means.

By participating in the event, you acknowledge that Guinness World Records has its own rules and requirements, and we cannot guarantee that the record attempt will be successful or officially recognized by Guinness World Records.

We reserve the right to withdraw or amend the Service, and any service or material we provide on the Service, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Service is unavailable at any time or for any period.
We may restrict access to some parts of the Service, or the entire Service, to users, including registered users, at any time without notice.
In no event will MIDI Lab AI, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
Our total liability to you for all claims arising from or related to the use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.
You agree to defend, indemnify, and hold harmless MIDI Lab AI and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
We shall not be liable for any failure or delay in performance under these Terms which is due to earthquake, fire, flood, act of God, act of war, terrorism, epidemic, pandemic, labor dispute, civil commotion, breakdown of communications facilities, breakdown of web host, breakdown of internet service provider, or other cause which is beyond our reasonable control.
In the event of a force majeure situation, we will make reasonable efforts to notify you and resume performance as soon as practicable. If the force majeure event continues for more than 30 days, either party may terminate these Terms with written notice.
You may not assign, transfer, or sublicense these Terms or any rights or obligations hereunder without our prior written consent. We may assign, transfer, or delegate these Terms and our rights and obligations without restriction. Any attempted assignment in violation of this section shall be void.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Governing Law: These Terms shall be interpreted and governed by the laws of the United States, without regard to its conflict of law provisions.
Jurisdiction: Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in the United States.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
You agree that any disputes arising out of or relating to these Terms or the Service will be resolved on an individual basis, and you waive your right to participate in a class action lawsuit or class-wide arbitration against us.
If this class action waiver is found to be unenforceable, then the entire dispute resolution section will be void, and any disputes will be resolved in the courts as specified in the Governing Law section.
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

"MIDI Lab AI" is a registered trademark of MIDI Lab AI, Inc. (Trademark Serial No. 99560175). All rights to the MIDI Lab AI name, logo, and brand are reserved.
